NEW ZEALAND GOVERNMENT BUSINESS IMMIGRATION AND RESIDENCY POLICY

The New Zealand Government has created the Entrepreneur policy to provide a pathway to permanent residence for existing or prospective business migrants, who can contribute towards the country’s economic development. Relaxing some of the immigration rules in November 2009 has meant that residency is fast tracked for migrants who reach the necessary criteria. The following is our understanding of the new rulings, and all interested parties are to make their own inquiries as to the validity of the information being presented.

Please find below a summary of the steps required for a migrant to take to achieve residency within a short time period:

STEP 1: Long Term Business Visa (LTBV)

This is a three year temporary work visa or permit that will allow a self employed migrant to set up, purchase or invest in a New Zealand business. The migrant must own at least 25% of a business and have an active part in its running. This Visa will be granted if the migrant can prove that he/she has the relevant business experience for the new business; has sufficient funds to support themselves and family for this time; and provides a detailed business plan for the proposed business. A reasonable level of English, good health and character are also essential.

After two years on the LTBV, the migrant can apply for either the “Entrepreneur Category” or the “Entrepreneur Plus Category”. Those approved under these categories are granted New Zealand residency.

STEP 2: Entrepreneur Category

This is a natural carry on of the LTBV and aims to attract migrants who have actively participated in business and contributed to the New Zealand economy. The migrant will need to prove that they have either established or purchased a New Zealand business, or own at least 25% of a New Zealand business. In all three cases, active involvement by the migrant has to be proved and that the business is of benefit to New Zealand’s economy.

While there is no predetermined monetary amount required on purchasing, setting up or investing in a New Zealand business under this category, at least one New Zealander should be employed full time (at least 30 hrs per week). Paper work such as a purchase agreement for the business, financial reports, bank statements, Inland Revenue payments etc., can be used as proof.

OR STEP 2: Entrepreneur Plus Category (Fast tracked New Zealand residence)

This is a definite investment of at least NZ$500,000 towards the purchase, establishment or development of a business. These funds can be introduced in stages (e.g.: purchasing a business and then purchasing business premises or more equipment) and full time employment (at least 30 hours per week) has to be given to at least three New Zealanders. Again, detailed paper work and financial reports are essential as proof. Also, as above, the business has to be of benefit to New Zealand and the choice of business will have a direct bearing on the success of an application for residency under the Entrepreneur category.
